As the modernists here remind us every chance they get, Catholic social teaching (which they incorrectly label "social justice") is an integral part of Catholicism. Thus, if what the Church does in its schools and hospitals is an integral part of the exercise of the Catholic faith, then those aspects have a claim to First Amendment protections.<br /><br />Given prosecutorial discretion, the government can quite easily seek to further its political agenda by choosing what sort of cases to file (and not to file).
